Terms of Service

1. Acceptance of Terms

By accessing and using Linkcast, you accept and agree to be bound by the terms and provision of this agreement.

2. Service Description

Linkcast is a Web3 paywall platform that enables creators to monetize content links through direct USDC payments on the Base Network.

3. Marketplace Disclaimer

Linkcast operates as a marketplace platform, not as a content seller. We facilitate transactions between creators and buyers but do not sell content directly.

• The platform only intermediates transactions between creators and buyers.
• Content quality and accuracy are the sole responsibility of the creator.
• Linkcast does not review, verify, or endorse any content sold through the platform.

4. Payment Terms and No Refund Policy

All payments are processed through blockchain transactions on the Base Network. A platform fee of $0.20 USDC applies to all transactions.

All payments are final and non-refundable due to the nature of blockchain transactions:

• Blockchain transactions cannot be reversed or cancelled once confirmed.
• The PaymentSplitter smart contract immediately distributes funds to the creator and platform upon payment.
• As a non-custodial platform, Linkcast does not hold user funds and therefore cannot process refunds.
• By making a purchase, you acknowledge and accept that you will not be able to request a refund from the platform.

5. Digital Content and Right of Withdrawal

Due to the nature of digital content:

• Access to content is granted immediately upon payment confirmation.
• By proceeding with a purchase, you expressly consent to immediate delivery and acknowledge that you waive your right of withdrawal.
• This exemption is in accordance with consumer protection laws regarding digital content (including Article 17(2) of the Korean E-Commerce Act and EU Directive 2019/770 Article 16(m)).

6. Dispute Resolution

In case of disputes:

• Technical issues (payment completed but no access): Contact our support team at /support. We will investigate and resolve technical problems.
• Content quality concerns: Please contact the creator directly. The platform does not mediate content quality disputes.
• Fraud or scam reports: Report to the platform. We may take action against creators violating our policies, including account suspension.
• Monetary refunds: At the creator's sole discretion. The platform cannot force or process refunds.

7. Prohibited Jurisdictions

Linkcast services are not available in certain jurisdictions due to regulatory requirements. By using our service, you confirm that you are not located in, under the control of, or a national or resident of:

• North Korea (Democratic People's Republic of Korea)
• Iran
• Syria
• Cuba
• Russia
• Crimea, Donetsk, or Luhansk regions
• Any other country or territory subject to comprehensive OFAC sanctions

We reserve the right to restrict access from additional jurisdictions at any time without prior notice.

8. Sanctions Compliance

By using Linkcast, you represent and warrant that:

• You are not listed on the U.S. Treasury Department's Office of Foreign Assets Control (OFAC) Specially Designated Nationals (SDN) List or any other sanctions list.
• You are not acting on behalf of, or for the benefit of, any person or entity on such lists.
• Your funds are not derived from illegal activities, including but not limited to money laundering, terrorist financing, or sanctions evasion.
• You will not use any tools, such as VPNs or proxies, to circumvent geographic restrictions imposed by the platform.

Violation of these representations may result in immediate termination of access and reporting to relevant authorities.

9. Right to Block and Terminate

Linkcast reserves the right to block, suspend, or terminate access to the platform without prior notice if:

• We detect access from a prohibited jurisdiction.
• Your wallet address is identified on the OFAC SDN list or other sanctions lists.
• We identify suspicious activity that may indicate sanctions evasion or illicit use.
• We are required to do so by law, regulation, or government order.

In such cases, any pending transactions may be cancelled and funds may be frozen in accordance with applicable law.

10. Prohibited Content

Creators may not sell or distribute the following types of content through Linkcast:

• Illegal content: Pirated material, malware, stolen data, or any content that violates applicable laws.
• Adult content: Pornographic or sexually explicit material.
• Harmful content: Hate speech, harassment, threats, or content promoting violence.
• Fraudulent content: Misleading, deceptive, or scam content designed to defraud buyers.
• Infringing content: Content that violates intellectual property rights, including copyrights and trademarks.

Violation of these rules may result in immediate content removal, account suspension, and permanent ban from the platform. Linkcast reserves the right to report illegal activities to relevant authorities.

11. User Responsibilities

Users are responsible for maintaining the security of their wallet and for all activities that occur under their account.

• You are solely responsible for safeguarding your wallet private keys and recovery phrases.
• Any transaction signed by your wallet is considered authorized by you.
• Linkcast is not responsible for any loss resulting from unauthorized access to your wallet.

12. Limitation of Liability

Linkcast shall not be liable for any indirect, incidental, special, consequential or punitive damages resulting from your use of the service, including but not limited to:

• Loss of funds due to blockchain network issues or smart contract failures
• Content that does not meet your expectations
• Unauthorized access to your wallet
• Service interruptions or technical failures
